Below, we would like to inform you about the processing of personal data carried out by CONVOTIS Schweiz AG. Please read our privacy policy carefully. If you have any questions or comments about this privacy policy, you can send them to the email address provided in section 1 at any time. 

This privacy policy is designed to meet the requirements of the EU General Data Protection Regulation (GDPR) and the revised Swiss Data Protection Act (DSG). However, whether and to what extent these laws apply depends on the individual case.

2. Collection and processing of personal data, as well as the nature and purpose of its use

a) When visiting the website
When you visit our website www.convotis.ch, the browser used on your device automatically sends information to our website server. This information is temporarily stored in a log file. The following information is collected by us without your intervention and automatically deleted after 3 months:

  • IP address of the requesting device,
  • Host name of the requesting device,
  • Date and time of access,
  • Name and URL of the file accessed,
  • Website from which access is made (so-called referrer URL),
  • Device type and operating system of your terminal device,
  • Browser type and version used, as well as other information transmitted by the browser (such as geographical origin, language settings, add-ons used, screen resolution, etc.).

We process the above data for the following purposes:

  • Ensuring smooth connection to the website,
  • Ensuring the best possible use of our website,
  • Evaluating system security and stability, and
  • For other administrative purposes.

b) Bei Anmeldung für unseren Newsletter

Where applicable, the legal basis for data processing is Art. 6(1)(f) GDPR. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the data collected in this way for the purpose of drawing conclusions about your person.

In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations on this in sections 3 and 4 of this privacy policy.

c) When using our contact form

If you have any questions, you can contact us using the form provided on the website. You will need to provide a valid email address, your first and last name, your postcode and your telephone number so that we know who the enquiry is from and can respond to it. Further information (e.g. uploading application documents) can be provided voluntarily.

Data processing for the purpose of contacting us is based on your voluntary consent (e.g. in accordance with Art. 6(1)(a) GDPR).

The personal data collected by us for the use of the contact form will be automatically deleted after completion, at the latest 3 months after your enquiry.

d) Social networks
We may use plug-ins from social networks such as Xing, LinkedIn, Facebook, Twitter, Instagram or YouTube on our websites. This is always visible to you (typically via corresponding symbols). We have configured these elements so that they are deactivated by default. If you activate them (by clicking on them), the operators of the respective social networks can register that you are on our website and where, and can use this information for their own purposes. The processing of your personal data is then carried out under the responsibility of this operator in accordance with its data protection regulations. We do not receive any information about you from this operator.

e) Other purposes
We reserve the right to process your personal data for other purposes. However, we will inform you of this at the appropriate point and, if necessary, obtain your consent.

f) Personal data abroad

We generally process personal data in Switzerland and the European Economic Area (EEA). However, we may also transfer personal data to other countries, including for processing or to have it processed there.

We may transfer personal data to all countries and territories around the world, provided that the local law guarantees adequate data protection in accordance with the decision of the Swiss Federal Council or the European Commission.

We may transfer personal data to countries whose laws do not guarantee adequate data protection, provided that data protection is guaranteed for other reasons (e.g. on the basis of standard data protection clauses or other appropriate safeguards). In exceptional cases, we may export personal data to countries without adequate or appropriate data protection if specific data protection requirements are met (e.g. the express consent of the data subject or a direct connection with the conclusion or execution of a contract).

3. COOKIES

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website.

The cookie stores information that is related to the specific device used. However, this does not mean that we immediately become aware of your identity.

The use of cookies serves, on the one hand, to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognise that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

In addition, we also use temporary cookies to optimise user-friendliness, which are stored on your device for a specific period of time. If you visit our site again to use our services, it will automatically recognise that you have already been with us and what entries and settings you have made so that you do not have to enter them again.

On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you (see section 4).

If the cookies mentioned contain personal data, their use is based on legitimate interests, in particular our interest in optimising our website.

Most browsers automatically accept cookies. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears before a new cookie is created. However, completely deactivating cookies may mean that you cannot use all the functions of our website.

Optional cookies used on our website, including their duration of use and purpose:

  • _ga (2 years): The _ga cookie, installed by Google Analytics, calculates visitor, session and campaign data and also tracks website usage for the website’s analytics report. The cookie stores information and assigns a randomly generated number to recognise unique visitors.
  • _gid (1 day): The _gid cookie installed by Google Analytics stores information about how visitors use a website and creates an analytics report on the website’s performance. The data collected includes the number of visitors, their source, and the pages they visit.
  • _gat_gtag_UA_50940963_1 (1 minute): Set by Google to distinguish users.

4. TRACKING-TOOLS

We use tracking measures to ensure that our website is designed to meet your needs and to continuously optimise it. We also use tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. These interests are to be regarded as legitimate in the context of data protection law (if applicable under Art. 6 para. 1 lit. f GDPR).

a) Google Tag Manager
We use Google Tag Manager. The provider is Google Ireland Limited (‘Google’). Google Tag Manager is a tool that helps us integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, store cookies or perform independent analyses. It is used solely to manage and display the tools integrated via it. However, Google Tag Manager collects your IP address, which may also be transferred to Google’s parent company in the United States.

b) Google Analytics
We sometimes use Google Analytics or similar services on our websites. This is a service provided by third parties who may be located in any country in the world (in the case of Google Analytics, it is Google Ireland (based in Ireland), which relies on Google LLC (based in the USA) as its processor (both ‘Google’) www.google.com), which we use to measure and evaluate website usage (not personal data). Permanent cookies set by the service provider are also used for this purpose. We have configured the service so that the IP addresses of Google visitors in Europe are truncated before being forwarded to the USA and cannot therefore be traced. We have disabled the ‘Data sharing’ and ‘Signals’ settings. Although we can assume that the information we share with Google is not personal data for Google, it is possible that Google may use this data for its own purposes to draw conclusions about the identity of visitors, create personal profiles and link this data to the Google accounts of these individuals. If you have registered with the service provider yourself, the service provider also knows you. The processing of your personal data by the service provider is then carried out under the responsibility of the service provider in accordance with its data protection regulations. The service provider only informs us about how our respective website is used (no information about you personally).

You can prevent the installation of cookies by adjusting your browser software settings accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent.

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on.

c) Google and Hotjar conversion tracking

In order to statistically record the use of our website and evaluate it for the purpose of optimising our offer for you, we also use Google Conversion Tracking with Tag Manager and Hotjar. Google Adwords sets a cookie (see section 3) on your device if you have accessed our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the AdWords customer’s website and the cookie has not yet expired, Google and the customer can recognise that the user clicked on the ad and was redirected to this page.

Each AdWords customer receives a different cookie. Cookies cannot therefore be tracked across the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in the tracking process, you can also refuse the necessary cookie setting – for example, by changing your browser settings to disable the automatic setting of cookies in general. You can also disable cookies for conversion tracking by setting your browser to block cookies from the domain ‘www.googleadservices.com’. 5. PLUGINS AND TOOLS

a) Google Web Fonts (local hosting)
This site uses web fonts provided by Google to ensure consistent font display. The Google fonts are installed locally in Switzerland. No connection to Google servers is made.

b) Google Maps

This website uses the Google Maps map service. The provider is Google Ireland Limited (‘Google’).

In order to use the functions of Google Maps, it is necessary to process your IP address. This information may be transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this further data processing. If Google Maps is activated, Google may use Google Web Fonts for the purpose of uniform font display. When you call up Google Maps, your browser loads the required web fonts into your browser cache in order to display texts and fonts correctly.

The use of Google Maps is based on your consent (Art. 6 para. 1 lit. a GDPR); and any data transfer to the USA is based on your express consent when activating the plugin (Art. 49 para. 1 lit. a GDPR); consent can be revoked at any time with effect for the future.

Standard contractual clauses of the EU Commission also exist for data transfer to the USA.

c) Google reCAPTCHA

We use ‘Google reCAPTCHA’ (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (‘Google’).

The purpose of reCAPTCHA is to verify whether the data entry on this website (e.g. in a contact form) is made by a human or by an automated programme. For this purpose, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, length of time the website visitor stays on the website or mouse movements of the user). The data collected during the evaluation is forwarded to Google.

The reCAPTCHA analyses run entirely in the background. Website visitors are not notified that an analysis is taking place.

The storage and evaluation of the data is based on your consent (Art. 6 para. 1 lit. a GDPR); consent can be revoked at any time with effect for the future.

6. YOUR RIGHTS

You have the right:

  • To revoke your consent at any time. This means that we will no longer be permitted to continue processing data based on this consent in the future.
  • Request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data if it was not collected by us, and the existence of automated decision-making, including profiling and, where applicable, meaningful information about its details;
  • To request the immediate correction of inaccurate or incomplete personal data stored by us;
  • To request the deletion of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  • To request the restriction of the processing of your personal data, unless the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to have it deleted and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have lodged an objection to the processing;
  • To receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transfer to another controller, and 
  • To lodge a complaint with a supervisory authority. The supervisory authority for private controllers in Switzerland, among others, is the Federal Data Protection and Information Commissioner (FDPIC). If and to the extent that the GDPR applies, data subjects have the right to lodge a complaint with a competent European data protection supervisory authority.

7. RIGHT OF APPEAL

If your personal data is processed on the basis of legitimate interests, you have the right to object to the processing of your personal data if there are reasons for this arising from your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right of objection, which we will implement without you having to specify a particular situation.

8. DATA SECURITY

We use the widely used TLS (Transport Layer Security) protocol on our website in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

We also use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
